Legislative changes to the Aliens Act
Amendments to Finnish immigration legislation entered into force on 6 May 2025. These changes may affect, for instance, situations where an applicant receives a negative decision on a residence permit or asylum application, or where a valid residence permit is nearing expiry. The amendments also have an indirect impact on the appeal processes in immigration matters.
The legislation introduces new provisions clarifying what constitutes lawful and unlawful residence in Finland. The amended Act applies immediately upon its entry into force. Unlawful residence in Finland may, among other things, lead to the imposition of an entry ban.
In addition, the conditions for acquiring Finnish citizenship were tightened through earlier legislative reforms.
What happens if I receive a negative decision?
A negative decision on a residence permit application is typically accompanied by a removal order, i.e. a decision on refusal of entry or deportation. Under the new rules, the general principle is that if the applicant wishes to apply for a new residence permit, they must first leave Finland and lodge the initial residence permit application from abroad.
If an asylum application is rejected and the applicant submits a subsequent application, the Finnish Immigration Service (Migri) will decide whether or not to examine the new application. Filing a subsequent application does not automatically render the applicant’s stay in Finland lawful; the matter is assessed on a case-by-case basis.
A refusal-of-entry decision generally means that the applicant is not permitted to remain in Finland during the appeal process, unless an administrative court orders otherwise. In contrast, in cases of deportation, the appellant is often allowed to remain in Finland pending the outcome of the court proceedings. In such matters, it is strongly recommended to seek advice from a lawyer specialized in immigration law.
All negative decisions may be appealed before an administrative court. Legal assistance is available during the appeal process, and applicants may be represented either by a public legal aid attorney or by a private lawyer.
